    One of the highlights of the Affordable Care Act is that it has elucidated new ways by which quality performance will affect payment. As a result, there is now a high possibility of new false claims liabilities, both in the rendering of care and in reporting about it, making it a fertile playground for whistleblowers. Adherence to many compliance programs is necessary to neutralize these liabilities. Also, where payment varies based on measured performance, the legitimacy of those reports is critical. This has brought about a situation where compliance officers and quality managers will have to find ways to work together.

    This session will expound the two pathways to which problems in this area can originate: a) from quality failures in delivering care to quality reporting, and b) where false claims liabilities can arise.

    At a time where reimbursements are declining and there is appeal for more efficiency, health care providers run the risk of reducing quality in the process of trying to lower costs.
