    Event Summary:
Damages in patent infringement cases are nearly always hotly contested, in part because the underlying case law involving lost profits and reasonable royalties can be confusing and sometimes seemingly contradictory. Parties routinely engage in motion practice resulting in the exclusion of damages opinions, potentially derailing a case. Thus, it is imperative for both litigants and counsel to stay abreast of the latest trends and developments in patent damages to sidestep potential pitfalls.

Join our experts, Philip Green (Archway Research Group LLC) and Cleve Tyler, PhD (Berkeley Research Group, LLC) as they provide an in-depth overview of the patent damages landscape. Using admissibility metrics to identify key aspects of patent damages analyses that are often contested by parties, the speakers will offer insights and critical considerations that can help practitioners navigate the complexity of damages methods in patent infringement matters.

Key topics to be covered include:
    • Damages Opinions Admissibility Statistics
    • Disclosure Obligations in Damages Contentions and Reports
    • Licenses Comparability
    • Evaluating Non-Infringing Alternatives and Their Effect on Damages
    • Reasonable Royalty Methods
    • Lost Profits Methods
    • Apportionment to Patented Technologies
