  • (1888PressRelease) October 25, 2023 - SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 133.23 to update stakeholders on US Environmental Protection Agency (EPA) reporting rules for per- and polyfluoroalkyl substances (PFAS).

    ‘Toxic Substances Control Act (TSCA) Reporting and Recordkeeping Requirements for Perfluoroalkyl and Polyfluoroalkyl Substances’ (88 FR 70516) was signed into effect on September 28, 2023. It establishes requirements for recordkeeping and reporting for businesses who have imported or manufactured PFAS, including articles containing PFAS, for commercial purposes since January 1, 2011.

    SGS has published SafeGuardS 133.23 to provide an overview of the rule, which is based on the EPA TSCA section 8 (a) (7) promulgation and will add Part 705 to the Title 40 Code of Federal Regulations. It contains details of the definition for PFAS used in the finalized rule, with a note explaining that the definition is not congruent with the definition used by some US states.

    The SafeGuardS also explains how the EPA will provide a list of substances, the date from which the rule will be effective and details of the period during which businesses can collect information and complete reporting.
