SGS Publishes Overview of Proposed Changes to Ukrainian Food Contact Materials and Articles Legislation

  • (1888PressRelease) September 29, 2022 - SGS, the world’s leading testing, inspection and certification company, is advising stakeholders that Ukraine’s Ministry of Health has issued three draft legislation to regulate several categories of food contact materials and articles.

    Issued in August 2022, the draft Orders cover:
    1. Prohibition on the use of 2,4,4’-trichloro-2-hydroxydiphenyl ether in the manufacture of food contact plastics
    2. Migration requirements for lead and cadmium in ceramic food contact products:
    a. Category 1 – lead, no more than 0.8 mg/dm², cadmium, no more than 0.07 mg/dm²
    b. Category 2 – lead, no more than 4.0 mg/L; cadmium, no more than 0.3 mg/L
    c. Category 3 – lead, no more than 1.5 mg/L; cadmium, no more than 0.1 mg/L
    3. Criteria for the release of N-nitrosamines and N-nitrosatable substances from elastomer and rubber teats and soothers:
    a. N-nitrosamines: no more than 0.01 mg/kg
    b. N-nitrosatable substances: no more than 0.1 mg/kg

    When/if accepted, these draft orders will further align Ukraine’s regulations for food contact materials and articles with EU requirements:
    • Order 1 aligns with Commission Decision 2010/169/EU of March 19, 2010 ‘Non-inclusion of 2,4,4’-trichloro-2-hydroxydiphenyl ether in the Union list for the manufacture of food contact plastics’
    • Order 2 aligns with Directive 84/500/EEC ‘Food contact ceramics’
    • Order 3 aligns with Directive 93/11/EEC ‘Release of N-nitrosamines and N-nitrosatable substances from elastomer or rubber teats and soothers’
