However, despite the growing number of states that have legalized marijuana, it is classified as a Schedule I substance under the Controlled Substances Act and remains illegal under federal law. In January 2018, the Department of Justice rescinded the Cole memorandum, an Obama-era directive to US attorneys ordering them to focus on prosecuting major distributors and more serious marijuana-related offenses, such as selling to minors. The revocation of the Cole memorandum effectively allows federal prosecutors to decide how to prioritize and pursue enforcement of federal marijuana laws.
