Support in ECHA for Proposal to Restrict Four Phthalates in Consumer Products
ECHA gains support from two of its committees for a proposal to restrict four phthalates in articles containing plasticized materials.
- (1888PressRelease) April 08, 2017 - Two committees of the European Chemicals Agency (ECHA) have given their support to the proposal to restrict four phthalates in articles containing plasticized materials. On March 21, 2017, the ECHA published an announcement that both the Committee for Risk Assessment (RAC) and Committee for Socio-Economic Analysis (SEAC) had given their support to the proposal.
The proposition by ECHA and Denmark relates to articles containing any of four phthalates:
• Bis(2-ethylhexyl) phthalate - DEHP
• Benzyl butyl phthalate - BBP
• Dibutyl phthalate - BDP
• Diisobutyl phthalate - DIBP
The proposal requires that the proscribed phthalates are restricted to less than or equal to 1%, individually or in total.
According to the Annex XV Restriction Report, the proposed restriction includes products such as:
• Coated fabrics and paper
• Flooring, footwear
• Mattresses
• Office supplies and equipment
• Recreational gear and equipment
• Other articles molded from or coated with plastic
The proposal does contain several exemptions, including:
• Articles covered by Directive 2011/65/EU (RoHS Recast)
• Food contact materials governed by Regulations (EC) 1935/2004 and (EU) 10/2011
• Immediate packaging of medicinal products (Regulation (EC) 726/2004, Directives 2001/82/EC or 2001/83/EC)
• Measuring devices for laboratory use
• Medical devices (Directives 90/385/EEC, 93/42/EEC or 98/79/EC)
• Toys and childcare articles governed by entry 51 to Annex XVII of REACH (BBP, DBP and DEHP)
If the proposal is adopted, it will amend entry 51 to Annex XVII of REACH by including DIBP within its scope.
If the restriction is implemented, it will become effective three years after the date of entry into force, upon acceptance by the European Commission (EC) and publication in the Official Journal of the European Union (OJEU). This suggests Stakeholders would have until 2020 or 2021 to make sure they are compliant with the revised restrictions.
