US State of Colorado Becomes Latest Place to Regulate PFAS in Consumer Goods

  • (1888PressRelease) June 24, 2022 - SGS, the world’s leading testing, inspection and certification company, is advising stakeholders that the US state of Colorado has become the latest jurisdiction to regulate per- and polyfluoroalkyl substances (PFAS) in consumer goods.

    The state governor signed HB 22-1345 into law on June 3, 2022. This regulates the sale or distribution of a wide variety of products and product categories that contain intentionally added PFAS. The new law also covers PFAS chemicals that are intentional breakdown products of an added chemical (PFAS precursors).

    The law covers:
    • Carpets and rugs
    • Fabric treatments – currently exempts hydrofluoroolefins used as propellants
    • Food packaging derived from plant fibers
    • Juvenile products – various exemptions, including electronic products
    • Oil and gas products
    • Cookware
    • Cookware handles or any cookware surface that comes into contact with food, foodstuffs or beverages
    • Cosmetics – currently exempts hydrofluoroolefins used as propellants
    • Indoor textile furnishings
    • Indoor upholstered furniture
    • Outdoor textile furnishings
    • Outdoor upholstered furniture

They are advised to refer to the original document to learn more about the details of the new law, which will be implemented in phases, beginning in January 2024.

    Stakeholders should also be aware that the law includes a provision restricting the use of intentionally added PFAS in Class B firefighting foams from January 1, 2024.
