  • (1888PressRelease) November 01, 2019 - The US Consumer Product Safety Commission (CPSC) has issued a notice of proposed rulemaking (NPR) to exempt several unfinished manufactured fibers in toys and childcare articles from undergoing third-party testing.

    The proposal was published on October 9, 2019 to determine if these fibers do not exceed the regulatory limits for ASTM F963 soluble elements and/or phthalates, meaning the:
    • Eight soluble elements in ASTM F963 (16 CFR 1250)
    • Eight phthalates in toys and childcare articles under 16 CFR 1307

    Unfinished manufactured fibers are defined as fibers that have no chemical additives beyond those used during manufacturing, i.e. no chemicals to impact coloring or performance (e.g. flame retardancy).

    The unfinished manufactured fibers under consideration for exemption from third-party testing are:

    Toys - ASTM F963 soluble elements:
    • Acrylic and modacrylic
    • Natural rubber latex
    • Nylon
    • Polyurethane (spandex)
    • Viscose rayon

    Toys and childcare articles – phthalates:
    • Acrylic and modacrylic
    • Natural rubber latex
    • Nylon
    • Polyurethane (spandex)
    • Viscose rayon
    • Polyester (polyethylene terephthalate, PET)

    There is now a 75-day comment period, with the CPSC accepting comments until December 23, 2019. A final rule will then be made following responses to the comments. Stakeholders can expect the provisions of the final rule to take effect 30-days after it is published.
