    In June 2012, the Public Consulting Group (PCG), which was under contract with the North Carolina Division of Medical Assistance (DMA), conducted a post-payment review and audit of Medicaid claims submitted by the provider. PCG reviewed 107 sample claims from the provider and found an error rate of 7.48%. Using a mathematical extrapolation formula, PCG estimated the provider needed to repay Medicaid more than $1,144,000.

    Mr. Indest and his team at The Health Law Firm were brought on to assist the provider in challenging the initial audit. They assembled and submitted documents to the auditor and assisted the client in presenting evidence at the hearing. The final results of the hearing, as documented in a decision in October 2012, reduced the Medicaid overpayment amount to just $24,083.
