SGS Summarizes Revisions to Oregon’s Toxic-Free Kids Act

  • (1888PressRelease) August 24, 2023 - SGS, the world’s leading testing, inspection and certification company, has published a SafeGuardS to help stakeholders understand recent amendments to the US state of Oregon’s disclosure program for children’s products.

    HB 3034 (Chapter 426, 2023) was approved in July 2023, amending the Toxic-Free Kids Act. This act authorizes the Oregon Health Authority (OHA) to establish and maintain a list of High Priority Chemicals of Concern for Children’s Health (HPCCCH) used in the manufacture of products for children under the age of 12. It also sets up reporting requirements for manufacturers when an HPCCCH is either intentionally added and equal to, or greater than, the practical quantification limit (PQL), or a contaminant that is equal to, or greater than, 100 ppm.

    HB 3034 allows the OHA to better regulate HPCCH in children’s products. Revisions include new definitions for ‘Class of chemicals’ and ‘Subclass of chemicals‘, and a mandate that the brand name and model must be included in the reporting requirements.

    SGS has published SafeGuardS 098.23 to help stakeholders gain a better understanding of the changes brought in by HB 3034. It includes details of the requirements to remove and substitute an HPCCH if the product is a cosmetic, intended for children under three or ‘mouthable’. There is also a summary of the revisions and information on effective dates.
