SGS Issues SafeGuardS on New French Repairability Decrees

  • (1888PressRelease) May 26, 2023 - SGS, the world’s leading testing, inspection and certification company, has published a SafeGuardS to help stakeholders understand France’s recently published decrees aimed at improving the repairability of motorized DIY and gardening tools, sports and leisure equipment and motorized travel equipment.

    Decrees No. 2023-293, 294 and 295 were published in the Official Journal on April 22, 2023. Relating to Article 30 of the Climate and Resilience Law, they seek to guarantee the availability of spare parts, including those from the circular economy, in order to enable the maintenance and repair of defined products.

    Decree No. 2023-292 relates to manufacturers and importers. Decree No. 2023-294 is for professionals offering maintenance and repair services. Decree No. 2023-295 covers consumer information on the conditions of sale of parts from the circular economy in the context of maintenance or repair services.

    Producers are required to make spare parts available under Article 30 of the Climate and Resilience Law. The law includes a minimum period of availability and requires repairers, outside of any legal guarantee, to offer an alternative to new spare parts that should come from the circular economy.

    SGS has published SafeGuardS 054.23 to help stakeholders gain a better understanding of the provisions in Decrees No. 2023-293, 294 and 295. It includes a breakdown of what is contained in each decree and has lists containing the products and spare parts that must be made available and for how long.

    • Sports and Leisure items
    • Motorized personal transport devices
