SGS Details New Chemical Reporting Rules and Restrictions in Washington State

  • (1888PressRelease) June 29, 2023 - SGS, the world’s leading testing, inspection and certification company, has published a SafeGuardS to help stakeholders gain a better understanding of Washington State’s new reporting requirements and restrictions for various priority products containing defined chemicals.

    Issued under the Safer Products for Washington program, signed into law in May 2019, the final rule focuses on five priority chemical classes:
    • Per- and polyfluoroalkyl substances (PFAS)
    • Ortho-phthalates
    • Flame retardants
    • Alkylphenol ethoxylates
    • Bisphenols

    It applies to a several products categories, including:
    • Electronics
    • Food and drink cans
    • Laundry detergents
    • Furnishings (carpets, rugs, leather and textile furniture, vinyl flooring)
    • Thermal paper

    A preliminary draft was released on August 9, 2022, with a proposed formal draft being issued in December 2022. The final rule’s main framework remains consistent with these drafts but there were changes.

    SGS has published SafeGuardS 069.23 to help stakeholders more fully understand the scope and requirements in the final rule. It explains a little about the background to the Safer Products for Washington program before detailing the changes between the proposed and final rules. It explains the concept of rebuttable presumption and includes tables detailing the scope of each priority chemical, including effective dates.

    To gain a clear picture of how this final rule will impact business, stakeholders are advised to review SGS’s original SafeGuardS 069.23.

    The final rule will become effective on July 1, 2023.
