New York First US State to Mandate Ingredient Labeling for Menstrual Products

  • (1888PressRelease) November 13, 2019 - The state of New York has become the first region in the US to introduce a legal requirement that all menstrual products must “contain a plain and conspicuous list of all ingredients.”

    Signed into law by Governor Andrew Cuomo on October 11, 2019, this new legislation (S.2387-B/A.164-B) requires an ingredients list that contains all intentionally added substances, making it consistent with other federal and state regulations for consumer products.

    The law applies to any menstrual product, either disposable or reusable, that is used to catch menstruation and/or vaginal discharge. This includes, but is not limited to, tampons, pads and menstrual cups.

    Manufacturers will be given a period of 18 months to make their menstrual product packaging compliant with the law’s requirements. It should be noted, these labeling requirements must be fulfilled in addition to other lawful labelling requirements; this is not a replacement.

    Violation of the law will result in a civil penalty of up to one percent of the manufacturer’s total sales but will to exceed USD 1,000 per package or box.

    New York is the first federal or state in the US to mandate an ingredients list on products such as these. This is part of a country-wide move towards greater transparency for consumer product ingredients. By January 1, 2020, California will be the first state to require ingredient disclosure in cleaning products and, across the country, states are introducing bills to increase communication and transparency regarding ingredients, and fragrance and fragrance allergens, in cosmetics and personal care products.
