    Event Synopsis:
The November 2017 memorandum issued by the Patent Trial & Appeal Board (PTAB) entitled "Guidance on Motions to Amend in view of Aqua Products" has marked a significant impact on the patentability of amended claims in IPR proceedings. In the Federal Circuit’s Aqua Products v. Matal decision, the burden of persuasion on patent owners when proving the patentability of substitute claims, has been lifted. The guidance aims to provide clarity and certainty on how the Board will handle motions when amending future substitute claims.
