EU Alters Requirements for Cosmetic Dyes Used on Hair and Eyelashes

  • (1888PressRelease) May 23, 2017 - The European Commission (EC) has amended Annex III to Regulation (EC) 1223/2009, altering the regulations relating to cosmetic dyes for hair and eyelashes. The EC instituted the changes following its consideration of two opinions by the Scientific Committee on Consumer Products (SCCS) - SCCS1563/15 and SCCS1572/16.

    Adopted on March 25, 2015, SCCS opinion SCCS/1553/15 concluded that the following oxidative hair dye substances should be considered safe to use by professionals for the purposes of colouring eyelashes:
    • Toluene-2,5-Diamine
    • p-Aminophenol
    • 2-Methylresorcinol
    • Tetraaminopyrimidine Sulfate
    • Hydroxyethyl-p-Phenylenediamine Sulfate
    • 2-Amino-3-Hydroxypyridine

    Because these chemicals do pose a risk if they are applied in-expertly, the regulations do state they should only be used by professionals and the product must carry appropriate warnings.

    Following SCCS opinions SCCS1572/16 and SCCS1563/15, the Commission has also created separate reference numbers for:
    • N,N'-Bis(2-Hydroxyethyl)-2-Nitro-p-Phenylenediamine
    • 2,6-Dihydroxyethylaminotoluene

    Currently, these two substances are regulated under the generic entries 8 and 9 of Annex III.

    Amendments to Annex III to Regulation (EC) 1223/2009 were enacted by regulation (EU) 2017/237, published on February 10, 2017. They entered into force on March 2, 2017, twenty days after publication in the Official Journal of the European Union.
