  • (1888PressRelease) April 01, 2022 - SGS, the world’s leading testing, inspection and certification company, is advising stakeholders that the US Environmental Protection Agency (EPA) has extended the compliance date for regulations covering phenol, isopropylated phosphate (3:1) (PIP (3:1)).

    PIP (3:1) is a flame retardant and plasticizer used in plastic articles and as a functional fluid in aircraft and industrial machinery. It was among a group of five persistent, bioaccumulative and toxic (PBT) chemicals to be regulated by final rules issued in January 2021 under Section 6(h) of the Toxic Substances Control Act (TSCA).

    The other chemicals were:
    • 2,4,6-tris(tert-butyl)phenol (2,4,6-TTBP)
    • Decabromodiphenyl ether (DecaBDE)
    • Pentachlorothiophenol (PCTP)
    • Hexachlorobutadiene (HCBD)

    These five final rules were to be implemented in phases, starting on March 8, 2021.

    In September 2021, the EPA issued a final rule to extend the compliance date in regard to PIP (3:1) to March 8, 2022, relating to:

    • Prohibition on the processing and distribution of certain PIP (3:1)-containing articles
    • Use of PIP (3:1) in manufactured articles
    • Record keeping requirements applicable to economic operators (manufacturers, processors and distributors) of such articles

    A further final rule has now been published by the EPA, on March 8, 2022, further extending the compliance date in relation to these three provisions. They will now come into effect on October 31, 2024.

    Stakeholders should be aware the EPA intends to publish another proposal for new rulemaking on all five PBT chemicals in the spring of 2023.
