Canada Expands Scope of Consumer Products Containing Lead Law

  • (1888PressRelease) May 27, 2018 - On May 2, 2018, Canada published the Consumer Products Containing Lead Regulations (CPCLR): SOR/2018-83. This is a new regulation that repeals the Consumer Products Containing Lead (Contact with Mouth) Regulations (CPCLCMR), SOR/2010-273 amended by SOR/2016-171.

    The changes expand the scope of the regulations but retains the requirement for accessible parts to contain no more than 90 mg/kg lead content. The CPCLR covers:

    • Products that are brought into contact with the user’s mouth during normal use (same as CPCLCMR)
    • Products for use in learning or play by children under 14 years of age (previously restricted to three years old under CPCLCMR)
    • Clothing or clothing accessories for children under 14 years of age
    • Books or similar printed products for children under 14 years of age - do not apply if printed on paper or cardboard, and printed and bound in a conventional manner using conventional materials
    • Childcare articles that are designed and intended to facilitate the relaxation, sleep, hygiene, carrying or transportation of a child under 4 years of age

    Stakeholders were previously informed about the proposed changes in a December 2016. The new restrictions will come into effect six months after it is published in Part II of the Canada Gazette, giving an effective date of November 2, 2018.
