California Lists PFOA and PFOS Under PROP 65

  • (1888PressRelease) December 09, 2017 - The Californian Office of Environmental Health Hazard Assessment (OEHHA), part of the state’s Environmental Protection Agency (EPA), has listed perfluorooctanoic acid (PFOA) and perfluorooctane sulfonate (PFOS) as chemicals known to cause reproductive toxicity under California Proposition 65 (Prop 65).

    Listed on November 10, 2017, the change means:
    • By November 10, 2018, businesses must provide a ‘clear and reasonable’ warning before intentionally exposing people to PFOA and/or PFOS
    • By July 10, 2019, businesses must cease discharging PFOA and/or PFOS into sources of drinking water

    Stakeholders should be aware that new and revised language for a ‘clear and reasonable’ warning, known as a Prop 65 warning, will come into effect on August 30, 2018.

    PFOA and PFOS are surfactants that have several uses relating to the manufacturer of consumer products such as carpets, textiles, leather, food contact materials and articles like non-stick cookware, and paper coatings with anti-water, grease, oil, and/or stain properties. PFOA is also used during the manufacturing of fluoropolymers and fluoroelastomers.

    California Proposition 65 is the “Safe Drinking Water and Toxic Enforcement Act of 1986’, a unique consumer ‘right-to-know’ law which was passed by Californian residents in November 1986. The law requires the state of California to maintain a list of chemicals known to cause cancer, birth defects and other reproductive harm. Currently, the list contains around 800 substances.

    Stakeholders are now advised to check their products are compliant with the latest changes to maintain access to the Californian market.
