Brazil Revises Models for Toy and Juvenile Products’ INMETRO Certification

  • (1888PressRelease) October 29, 2018 - Brazil’s National Institute of Metrology Standardization and Industrial Quality (INMETRO) has issued an update to its certification scheme for toys and juvenile products.

    The certification scheme, INMETRO Ordinance 563/2016, provides three routes to achieving certification for toys and juvenile products. These are:

    • Certification Model 5 – Quality Management System Certification with product testing
    • Certification Model 2 – product testing followed by periodic maintenance assessment
    • Certification Model 1B (formerly 7) – batch certification

    Stakeholders should be aware of the following changes to these routes:

    • Certification 5
    o The factory shall present an ISO 9001 Quality Management System certificate, awarded by a recognized certification body
    o An audit will be requested (considering table 3 of Ordinance 118:2015)
    o Samples will be collected from the factory for testing
    o First maintenance check 6 months after initial evaluation, followed by another 6 months later. If no non-conformities are found during two consecutive maintenance checks, the period increases to 12 months
    o If a non-conformity is found, the frequency reverts to every 6-months
    • Certification 2
    o OCP must evaluate, validate and record classification as MEI, MPE and/or toy craftsman considering the requirements of item 6.1.1
    o Item 6.1.1 - Complementary Law nº 123 enforcement, December 14, 2006, and Complementary Law n.º 147, August 7, 2014, which changes the Complementary Law n.º 123, December 14, 2006, or any of its updates (in the case of Certification Model 2)
    o Samples will be collected from the factory for testing
    o First maintenance check 6 months after initial evaluation, followed by another 6 months later. If no non-conformities are found during two consecutive maintenance checks, the period increases to 12 months
    o If a non-conformity is found, the frequency reverts to every 6-months
    • Certification 1B
    o Certification done for every single batch
    o Sample size depends on the batch size, ranged from 3 to 71pcs
    o Sampling at origin is prohibited

    It should be noted the test requirements are:

    • NM300-1 Physical & Mechanical Requirement
    • NM300-2 Flammability
    • NM300-3 Migration of certain elements
    • NM300-4 Experimental chemistry sets
    • NM300-5 Chemistry sets other than experimental sets
    • NM300-6 Safety of electric toy. Phthalates, formamide, microbiological, bite and boiling requirements under Annex A of the Conformity Assessment Requirements of Ordinance 563/2016
    • Annex I Ordinance 563/2016 – Technical Quality Regulation for Toys

    To gain access to the Brazilian market, importers should apply to local Brazilian certification bodies (CBs). These will co-ordinate with the testing and inspection organization, such as SGS, to ensure the correct auditing, sampling and testing are performed. Reports are then sent to the CB, which will issue the necessary Certificate of Compliance.
