Canada Modifies Consumer Product Regulations under CCPSA

  • (1888PressRelease) September 25, 2016 - On July 13, 2016, Canada published a number of regulation revisions under the Canada Consumer Product Safety Act (CCPSA). The revisions were published in Canada Gazette Part II and, while changes have been made to 32 regulations, they do not create significant changes to regulatory requirements and will not affect the existing compliance and enforcement mechanisms.

    The CCPSA came into force in June 2011 with the objective of preventing dangers to human health and safety from consumer products. The legislation is administered by Health Canada and applies to manufacturers, importers, distributors, advertisers and retailers of consumer products in Canada.

    According to the regulatory impact analysis statement in Canada Gazette Part II, the initiative was designed to build on the 2011 regulatory revisions, with the "scope of application" being to revise various regulations in order to create greater consistency of legislative language in the CCPSA.

    In total, 29 regulations were repealed and replaced. In some cases, the new regulations also acquired a change of name, such as: 'Infant Feeding Bottle Nipples Regulations', 'Mattresses Regulations' and 'Pacifiers Regulations'.

    In addition, three other regulations were amended:
    • The Consumer Chemicals and Containers Regulations
    • The Consumer Products Containing Lead (Contact with Mouth) Regulations,
    • The Toys Regulations.

    These changes came into effect on June 22, 2016.
