  • (1888PressRelease) September 01, 2011 - Swift Human Resources, a Montreal-based company that offers HR solutions to small and medium-sized businesses, is helping companies complete the Salary Equity Exercise and consequently comply with Quebec's Pay Equity laws.

    The Pay Equity Act sets out, within a given reference period specified in the Act, obligations and responsibilities for employers depending on the number of employees. An employer's obligation increases with the number of employees in the company. There are three categories of business sizes; these range from 10 to 49 employees, 50 to 99 employees and 100+ employees.

    As of March 1, 2011, all Quebec employers with six or more employees must provide information annually in order to determine whether they are subject to the province's Pay Equity Act.

    Swift Human Resources founder and president, Faye Swift states, "Under Article 115 of the Pay Equity Act, the employer who does not submit an annual declaration commits an offense and is liable to substantial fines. Up until now, fines were seldom, if ever, imposed. This is about to change. The Commission de l'équité salariale's budget for inspectors and audits is expected to increase, over the next two years, by 75%."

    She explains further, "Employers who do not comply can face payments that include not only the amount owed in salary adjustments (with interest at the legal rate), but also an additional penalty that will be retroactive to the date when the adjustments were originally due. This penalty will be calculated in the manner prescribed by the Ministère du Revenu."
