  • (1888PressRelease) March 27, 2007 - Ludhiana, India March 10 - The insurance ombudsman having jurisdiction over Punjab, Haryana, Himachal Pradesh, Jammu and Kashmir and Chandigarh has made a land mark judgement in the case of two arthritis patients undergoing cytotron treatment. Somnath Gupta and his wife Swaran had cytotron treatment for their knee arthritis at Sibia Medical Centre, Ludhiana. The medical claim for the treatment was objected to by United India Insurance Company on the ground that hospitalization was not needed in their case. Gupta went to the insurance ombudsman, Chandigarh, who gave its judgment yesterday.

    Based on the information provided by the claimant, the insurer and the technical opinion of Dr Sibia, the judge ordered that the claim was payable like in case of any other disease. The cytotron therapy may or may not require hospitalization depending on the condition of the patient and in this case it was required.

    Further the judgment clarified that even if the cytotron therapy was taken without hospital stay it merited payment as it was adequately covered under clause 2.3 (a) that provides for treatments involving specialized infrastructure available in the hospital and 2.3 (b) that provides for treatments requiring hospitalization for less than 24 hours due to technological advances. This advanced technology to rehabilitate and treat osteoarthritis and cancer patients using high-power electromagnetic beams had shown some very positive results and was a breakthrough in medical science.
