March 22, 2008 - Kenan Jiang and Hao Junbo, senior practitioners in Lehman, Lee & Xu's litigation department, have recently won a number of court decisions. The firm, which specializes in assisting foreign companies with Chinese legal issues, won two separate court decisions for an Italian electronics control device manufacturer. The first case was against the Trademark Review and Adjudication Board and the second was against a distributor who was attempting to avoid an arbitration clause contained in their distribution agreement.
The wins are yet another addition to a long list of court victories that Lehman, Lee & Xu has achieved for international clients. However, foreign-related litigation is conducted in the Intermediate People’s Court in the first instance and the High People’s Court in the second instance, where senior judges are able to more able to exercise objective judgment in cases with international elements.
