While no numbers are available, anecdotal evidence suggests this is becoming the norm rather than the exception. Trustees are becoming more aggressive in pursuing preferences, explains Hal Schaeffer, a bankruptcy preference expert and president of D&H Credit Services, Inc, (www.dandhcredit.com) and defendants are fighting back even harder. We’re now getting requests for expert reports in smaller cases as well as the larger ones.
