January 09, 2009 - It has been reported from an anonymous source that there may be an agreement between attorneys representing Glaxo SmithKline and a group of attorneys representing plaintiffs to file a joint motion before the United States Judicial Panel on Multidistrict Litigation, requesting that all Paxil birth defect cases currently pending in the Federal courts be consolidated in a MDL before the Honorable Eldon E Fallon of the Eastern District of Louisiana. Judge Fallon is currently overseeing the Vioxx litigation in MDL 1657.
The filing of an MDL could result in a flood of new filing by plaintiffs. Paxil has been alleged to be the cause of significant heart defects in newborns exposed during pregnancy. Several hundred cases have been filed against the manufacturer, Glaxo SmithKline, “GSK”.
