November 03, 2009 - Arizona Attorney magazine has published articles on the much-publicized CityNorth development and the legality of cities providing tax incentives to private projects, written by representatives for the developer and the Goldwater Institute.
CityNorth is a 144-acre development in northern Phoenix that is designed to include restaurants, retail, condominiums and hotels.
The Goldwater Institute has filed a lawsuit against the City of Phoenix for funding the project with a $97.4 million sales-tax incentive package. The Institute claims the tax package is a violation of the Gift Clause of the Arizona Constitution.
Turken v. Gordon is now before the Arizona Supreme Court, which heard oral arguments on Sept. 30.
